1. License to Use

Unless otherwise stated, Aartas Care Private Limited owns the intellectual property rights in HiGalen and material on HiGalen. Subject to these Terms, Aartas Care grants you a limited, non-exclusive, non-sublicensable, revocable license to access and use the HiGalen platform for your personal or professional healthcare management purposes.

2. Acceptable Use

You must not use HiGalen in any way that causes, or may cause, damage to the platform or impairment of its availability or accessibility. Specifically, you must not:

• Use the platform in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms
• Use the platform to copy, store, host, transmit, send, use, publish, or distribute any material that consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit, or other malicious software
• Conduct any systematic or automated data collection activities without our express written consent
• Use HiGalen to transmit or send unsolicited commercial communications
• Use HiGalen for any purposes related to marketing without our express written consent
• Attempt to reverse engineer, decompile, or disassemble any portion of the software

3. User-Generated Content

Where you submit or upload content to HiGalen — including patient records, notes, documents, or images — you grant Aartas Care a worldwide, non-exclusive, royalty-free license to use, reproduce, and process such content solely for the purpose of providing and improving the Services.

You represent and warrant that you have the necessary rights and consents to submit such content, and that it does not infringe the rights of any third party.

4. AI-Generated Content

HiGalen uses artificial intelligence to generate suggestions, prescriptions, diagnoses, and other clinical content. You acknowledge that:

• AI-generated content is provided as a decision-support tool only
• All clinical decisions remain the sole responsibility of the licensed healthcare professional
• You must review all AI-generated suggestions before acting on them
• Aartas Care does not warrant the accuracy, completeness, or fitness for purpose of AI-generated content

5. Restricted Access

Access to certain areas of HiGalen is restricted. Aartas Care reserves the right to restrict access to any areas of HiGalen, or indeed the whole platform, at its discretion.

If Aartas Care provides you with a user ID and password to enable you to access restricted areas, you must ensure that the user ID and password are kept confidential. You alone are responsible for the security of your account.

6. No Warranties

HiGalen is provided "as is" without any representations or warranties, express or implied. Aartas Care makes no representations or warranties in relation to this platform or the information and materials provided on this platform.

Aartas Care does not warrant that HiGalen will be constantly available or available at all; or that the information on this platform is complete, true, accurate, or non-misleading.

7. Limitations of Liability

Aartas Care will not be liable to you (whether under the law of contract, tort, or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this platform for any indirect, special, or consequential loss; or for any business losses, loss of revenue, income, profits, or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

8. Indemnity

You hereby indemnify Aartas Care and undertake to keep Aartas Care indemnified against any losses, damages, costs, liabilities, and expenses (including legal expenses) arising out of any breach by you of any provision of these Terms, or arising out of any claim that you have breached any provision of these Terms.

9. Breaches of These Terms

Without prejudice to our other rights under these Terms, if you breach these Terms in any way, Aartas Care may take such action as it deems appropriate to deal with the breach, including suspending your access to the platform, prohibiting you from accessing the platform, and/or bringing court proceedings against you.

10. Variation

Aartas Care may revise these Terms from time to time. Revised Terms will apply from the date of their publication. Please check this page regularly to ensure you are familiar with the current version.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aartas Care in relation to your use of HiGalen, and supersede all previous agreements in respect of your use of the platform.
