By accessing or using HiGalen, you confirm that you are at least 12 years of age and agree to these Terms. If you are accessing the platform on behalf of a healthcare organisation, you also confirm that you have the authority to bind that organisation to these Terms.

2. Description of Services

HiGalen is an AI-powered Electronic Medical Records (EMR) platform designed for healthcare professionals in India. Our services include, but are not limited to:

• AI-assisted prescription and EMR generation
• Appointment scheduling and patient management
• Secure patient-doctor communication
• Analytics and clinical insights
• Team collaboration tools
• WhatsApp and email patient engagement

3. User Responsibilities

As a user of HiGalen, you agree to:

• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Use the platform solely for lawful medical practice purposes
• Comply with all applicable laws and professional standards, including the Indian Medical Council Act and any other relevant regulations
• Ensure patient consent is obtained where required before accessing or sharing patient data through our platform
• Promptly notify us of any unauthorised access to your account

4. Intellectual Property

All content, features, and functionality on HiGalen — including but not limited to text, graphics, logos, icons, images, audio clips, software, and AI models — are the exclusive property of Aartas Care Private Limited and are protected by Indian and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes only. You may not reproduce, distribute, modify, create derivative works of, or otherwise exploit the Services without our prior written consent.

5. Data and Privacy

Your use of HiGalen is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

6. Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose or in violation of any local, national, or international laws
• Violate or infringe upon the rights of others, including privacy and intellectual property rights
• Upload or transmit viruses or any other malicious code
• Attempt to gain unauthorised access to any portion of the Services or any related systems or networks
• Use automated scripts to access or scrape the Services
• Impersonate any person, healthcare professional, or organisation
• Misrepresent patient data or engage in fraudulent medical practices

7. Disclaimer of Warranties

HiGalen provides AI-generated suggestions as a decision-support tool only. All clinical decisions remain the sole responsibility of the licensed healthcare professional. The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Aartas Care Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of the Services.

Our total liability to you for any claims arising out of or relating to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your access to the Services at any time and for any reason, including but not limited to a violation of these Terms. Upon termination, your right to access and use the Services will immediately cease.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. We encourage you to first attempt to resolve any dispute amicably by contacting us.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by sending you an email or in-app notification. Your continued use of the Services after any change constitutes your acceptance of the new Terms.
